1.0 Definitions
• User - Anyone that creates a RentBOLD account.
• Item - Any object or service that is listed on RentBOLD's web site.
• Item Owner - Users that list items are considered item owners.
• Item User - During a rental, the individual that requested the item is considered the item user.
2.0 What is RentBOLD
2.1 RentBOLD is an internet based listing service that enables users to rent items to and from each other.
3.0 Fair System Use
3.1 RentBOLD reserves the right to revise this document at any time. Continued use of RentBOLD's services is contingent on the user's acceptance of the latest revision.
3.2 RentBOLD does not guarantee uninterrupted or continued service. Maintenance, high traffic, unavailable third party services and other events may cause the system to be unavailable.
3.3 RentBOLD's services and resources are not to be used for any other electronic system or activity without written consent.
4.0 Liability
4.1 RentBOLD is not liable for damages incurred as a result of using its services.
4.2 Use of RentBOLD is voluntary and at your own risk. When a rental begins, the item user accepts the item's condition as-is and assumes complete liability for the risks and responsibilities associated with transporting, using and storing the item.
4.3 Item users are fully liable for item damage, theft, property damage and injury to themselves and others.
4.4 An item's specified value represents the maximum amount an item owner expects to be paid by an item user if an item is totaled, lost or stolen. Item owners agree to assign realistic item values when registering items. Item users agree to make prompt payment to item owners.
4.5 The 'Ten Steps To A Successful Rental' document is considered legally binding when signatures and dates are provided by both parties.
5.0 Financial Policies
5.1 Users agree to pay RentBOLD system charges as defined in the What It Costs page. RentBOLD charges may change at any time.
5.2 RentBOLD does not guarantee that users will make or save money from using its services.
5.3 RentBOLD's invoice system can optionally be used for rental billing (billing between item owners and item users). RentBOLD does not assume financial liability for unpaid invoices.
5.4 Invoices must be paid on time. If a user has a concern regarding the payment of an invoice, the user will inform RentBOLD. If the invoice is related to a rental, the user will submit an assistance request by opening the rental in 'My Rentals' and clicking the 'Request Assistance' button. If the invoice is related to a RentBOLD system charge, the user will inform RentBOLD through customer support.
5.5 When rental payment is owed by invoice, the receiver of the payment has the ability to decrease the amount or delete it. The receiver of the payment must contact the payer if the amount of the invoice needs to be increased. If the payer is unwilling to increase the amount, the receiver may request assistance from RentBOLD by opening the rental in 'My Rentals' and clicking the 'Request Assistance' button.
5.6 When rental payment is due, by invoice, the payer has the ability to increase the amount. The payer must contact the receiver if the amount of the invoice needs to be decreased. If the receiver is unwilling to decrease the amount, the payer may request assistance from RentBOLD by opening the rental in 'My Rentals' and clicking the 'Request Assistance' button. To resolve concerns regarding RentBOLD system charges, the payer will contact RentBOLD through customer support.
5.7 Unpaid invoices are considered delinquent after seven days. After an invoice has been unpaid for 30 days, RentBOLD may attempt to contact the parties involved in order to resolve the problem.
5.8 Withdrawal requests may be delayed or denied if the user who made the request has unpaid invoices.
5.9 A fee may be applied by RentBOLD for delinquent invoice payment.
5.10 Delinquent payment of invoices is considered system abuse.
5.11 Item owners are not required to reduce rental costs when items are returned early. When an item is returned early, the item user may be charged as though the item was returned at the agreed upon time.
5.12 Item owners may apply fees when items are returned late. Item owners are allowed to charge an extra 50% of the rental rate for the amount of time that the rental is late. For example, if a rental is $10 per day, the time frame is three days and the item user returns the item after four days, the item user will be charged $10 per day for the first three days and may be charged up to $15 for the fourth day.
5.13 The Rental Bucks feature may be modified or cancelled at any time. Rental Bucks are not redeemable or transferable and may be subject to expiration.
5.14 RentBOLD does not guarantee that item owners will honor advertised acceptance of Rental Bucks. Making and receiving rental payment with Rental Bucks requires billing via RentBOLD's invoicing feature. RentBOLD will not compensate users for uncollected Rental Bucks.
5.15 Preferred payment methods are not enforced by RentBOLD.
5.16 Users are responsible for credit card processing if they designate 'credit card' as a preferred payment method.
5.17 RentBOLD is granted authority by its users to hold and manage funds that have been deposited into their RentBOLD account(s). Users will not receive interest from funds in their RentBOLD account(s).
5.18 Users are responsible for taxes incurred by using RentBOLD.
6.0 System Abuse
6.1 Using RentBOLD for any purpose other than its intended use is considered system abuse.
6.2 Attempting to circumvent RentBOLD system charges may be considered system abuse.
6.3 Contacting other users without their consent is considered system abuse.
6.4 Offensive, inaccurate or restricted data must be reported to RentBOLD. RentBOLD will be given a reasonable amount of time to assess and/or correct reported abuse.
6.5 Breach of any user agreement policy is considered system abuse.
6.6 The consequences of system abuse may include account suspension, account termination, financial liabilities and legal action.
7.0 Creating and Managing RentBOLD Accounts
7.1 Users must be at least 18 years old and legal residents of the United States.
7.2 RentBOLD accounts are limited to one per person. Users may have multiple accounts if granted permission by RentBOLD.
7.3 Account information (addresses, email addresses, phone numbers, etc.) is required to be accurate and current. User profile images must be representative of the owner of the account and not contain explicit, inappropriate or otherwise offensive content.
7.4 Users are responsible for creating and managing their own RentBOLD account(s).
8.0 Personal Information
8.1 RentBOLD does not guarantee the security of personal information.
8.2 Driving directions are provided to users when they are required to travel to exchange items.
8.3 Rentals may be contingent on proof of identification.
8.4 RentBOLD does not guarantee the accuracy or validity of personal information.
9.0 Data Submission
9.1 Some user data is viewable to the general public (user name, feedback, item details, etc.).
9.2 Submitted data is required to be truthful and absent of vulgarity, threats, racial inference or language of a harassing nature.
9.3 RentBOLD is not liable for copyright, trademark or intellectual property infringements by its users. Users responsible for such violations are liable for RentBOLD's related losses.
9.4 Submitted data becomes RentBOLD's property at the time of submission.
9.5 RentBOLD reserves the right to edit and purge data at any time.
9.6 RentBOLD is not liable for lost, stolen or intercepted data.
9.7 Manipulating account or item data during or after a rental for fraudulent purposes is considered system abuse.
10.0 Item Authenticity
10.1 RentBOLD does not guarantee that items are accurately represented (values, images, descriptions, conditions, defects, etc.). Truthful representation of an item is the responsibility of the item owner.
11.0 Restricted Items
11.1 The following list includes, but is not limited to, items that are restricted from being listed on RentBOLD: alcohol, tobacco, drugs or drug paraphernalia, sexual services, adult resources, obscene or offensive materials, pirated or copyrighted works, explosives, poisons, hazardous chemicals, illegal weapons, burglary tools, stolen items, protected items, illegal items, property with serial numbers removed, personal information, unauthorized medical devices, the human body, human or animal body parts, underwear, dirty clothing, restricted uniforms and badges, teacher's edition of text books and solutions manuals, fighting or menacing animals, endangered species and protected wildlife.
11.2 Listing restricted items is considered system abuse.
12.0 Electronic Messaging
12.1 RentBOLD communicates with its users through an internal messaging system. Messages are optionally forwarded to email addresses. Message forwarding may not be 100% reliable due to the nature of electronic mail.
12.2 Internal messages are not to be used to spam other users or for conducting non-rental activities.
12.3 Users may receive messages from other users. Some messages may be anonymous.
12.4 Users are not required to respond to inquiries from other users.
13.0 SMS (Text) Messaging
13.1 RentBOLD has an optional text message notification feature. Due to the nature of electronic communications, this feature may not be 100% reliable.
13.2 Carrier charges apply (based on your service plan).
13.3 When text message notifications are enabled, the user must be authorized to access and use the selected phone.
13.4 Due to the short nature of text messages, not all pertinent information may be included.
13.5 RentBOLD does not guarantee that all phones can receive text message notifications.
14.0 Blacklist
14.1 Users have the ability to blacklist other users at their discretion. Blacklisted users are blocked from communicating with the individuals who blacklisted them (requesting rentals, asking item questions, making offers to buy items, etc.). Users acknowledge and accept this practice to be fair.
14.2 Blacklisting a user may not stop all contact from him/her (contact information may have been given out previously).
15.0 Rental Assistance
15.1 RentBOLD provides an assistance service (arbitration) for resolving rental problems. Users agree to request RentBOLD assistance before presenting disputes to their local justice system or other arbitration services. Requesting assistance for rental related issues (unpaid damage, faulty equipment, resolution of late or early fees, etc.) through customer support (suggestion box, contact RentBOLD, etc.) is considered system abuse.
15.3 RentBOLD does not guarantee that it will be able to effectively resolve assistance requests. There are no time requirements for accepting, administering or resolving assistance requests. RentBOLD determines the amount of time that will be spent addressing assistance requests. RentBOLD may choose to deny assistance requests.
15.4 Decisions from this service are binding. Related security deposits and/or additional invoices may be utilized to collect payment for owed parties. RentBOLD is not liable for any decisions or costs as a result of a third party arbitration ruling that overrides a previous RentBOLD judgment.
15.5 If RentBOLD denies or cannot resolve an assistance request, personal and rental information may be provided by RentBOLD to both parties. This information may be used by either party to pursue third party arbitration.
16.0 Customer Support
16.1 RentBOLD may not respond to all to suggestions, complaints or inquiries.
16.2 System help features (tooltips, help documents, questions & answers articles, etc.) may not be complete or 100% accurate.
17.0 Account Suspension and Termination
17.1 RentBOLD may suspend or terminate user accounts for any reason, at any time and without notice. When an account is terminated or suspended, the remaining funds in the account may be placed on hold or withdrawn to pay existing or pending charges owed to RentBOLD or other parties.
17.2 All account activity (rentals, financial holds, invoices, etc.) must be resolved before users can terminate their account(s).
17.3 RentBOLD may contact previous users in order to address unresolved issues.
17.4 When an account is terminated, all items are deleted. Existing Rental Bucks are deleted and remaining funds (minus funds to pay outstanding charges) are sent by mail to the user's primary address.
17.5 When an account is involuntarily terminated, the associated user is not permitted to open a new account.
17.6 RentBOLD determines the conditions to unsuspend accounts.
18.0 Indemnity
18.1 RentBOLD is not liable for its users' future losses.
19.0 Miscellaneous
19.1 RentBOLD is not responsible for the performance, operation or successful use of items. Item owners are not responsible to train item users regarding the use, storage or transportation of items.
